1. General

These General Conditions of Sale (CGV) govern the contractual relations between the company SIMBELGIUM, specialized in the design, manufacture, and installation of high-end racing simulators, and the Customer, defined as any natural or legal person placing an order with SIMBELGIUM.

The e-commerce website of SIMBELGIUM, a company specializing in the design and sale of high-end racing simulators, offers customers the opportunity to purchase its products via its webshop. The company is domiciled at Brusselsesteenweg 150, 1785 Merchtem., registered under number BE0775473725.

Any order implies unreserved acceptance of these General Terms and Conditions. No other condition may prevail without prior written agreement from SIMBELGIUM.

These general conditions are applicable to all transactions carried out with Simbelgium, regardless of the channel used. By validating an order with SIMBELGIUM, the customer acknowledges having read and accepted these general conditions, without exception.

2. Products and services

The racing simulators, accessories and installation services offered are detailed on our website or our quotes. These descriptions include the essential characteristics of the products. SIMBELGIUM reserves the right to modify these characteristics without notice in order to improve the quality of the products. The descriptions of the products available on our site are produced with care. However, unintentional clerical errors or omissions may occur. SIMBELGIUM cannot be held responsible for incorrect information. We advise the customer to contact customer service for any specific questions regarding a product. Offers are valid while stocks last. SIMBELGIUM reserves the right to modify or withdraw an offer without notice.

3. Online shopping

Order: The items are added to the basket via the corresponding buttons. After validating the basket, the customer enters their information and chooses payment and delivery options. An order confirmation is sent by e-mail after validation.

Availability: The availability of products is indicated on their sheet. If an ordered product is out of stock, SIMBELGIUM will contact the customer to offer a solution with an equivalent product.

Paymentt: The accepted payment methods are detailed on the site and in the general conditions of sale. In the event of refusal of payment or an anomaly, SIMBELGIUM reserves the right to refuse the order. In accordance with Book VI of the Code of Belgian Economic Law, private consumers benefit from a right of withdrawal of 14 calendar days for contracts concluded remotely. This right does not apply to professionals or to goods personalized or manufactured according to the consumer's specifications, as specified in article VI.53 of the CDE.

For the purchase of individual products, excluding full pack simulators.  

• Products must be returned in their original condition, without having been used, damaged or showing signs of wear.

• Products must be returned in their original packaging, accompanied by all accessories, manuals and documents provided.

• Return costs are the responsibility of the Customer, except in the event of an error or defect attributable to SIMBELGIUM.

Deductions for non-compliance

• If the returned product shows traces of use, damage or wear affecting its resale as new, SIMBELGIUM reserves the right to deduct an amount corresponding to the repair or depreciation of the product before reimbursement.

To exercise this right, the consumer must notify his decision in writing to SIMBELGIUM.

4. Orders 

To place an order, the Customer must provide their full contact details (surname, first name, address, email, telephone number) and validate their order via a signed quote or order form, an online ordering system. Once the order has been validated, it is considered firm and final.

An acknowledgment of receipt of the order will be sent by e-mail, including a summary of the products, services and prices.
Uniquely :

Order cancellation: SIMBELGIUM reserves the right to cancel any order in the event of non-compliance by the customer with payment conditions or due to force majeure.

Refund Terms: For the purchase of individual products, excluding full pack simulators. In the event of cancellation by SIMBELGIUM, the reimbursement of the amount already paid will constitute proof and conclusion of the cancellation of the order.

5. Price

Prices are expressed in EUROS, excluding shipping costs and applicable taxes. Transport costs are communicated to the Customer before validation of the order and included in the invoice. SIMBELGIUM reserves the right to modify its prices at any time, but the products are invoiced at the rate in effect at the time of the order.

For deliveries outside the European Union, customs fees, taxes or import duties may be applied. These costs remain the responsibility of the Customer.

6. Payment

Payment is due when ordering, unless otherwise specified in a contract or quote. Accepted payment methods include:

Bank card • Bank transfer • Installment payment under conditions (with prior agreement).

Any order not paid within the deadline may be canceled or suspended by SIMBELGIUM.

Deposit when ordering: A deposit of 50% of the total amount is required when ordering.

Balance to be paid before delivery: The balance must be paid before delivery of the product.

If the invoice is not paid, the customer will not be able to receive their merchandise. 

Order validation: All orders are considered final once the deposit has been paid and the quote has been signed or validated by both parties.

No modification can be made after this validation, unless explicitly agreed by both parties.

Supply problem: In the event of difficulty related to the supply of the products ordered, the parties undertake to search together for an alternative or similar products in order to finalize the order.

Post-validation modifications: Any modification requested by the customer after validation of the order (for example, change in design of the seat, simulators, or other elements) will be subject to additional invoicing for cover the additional work and costs associated with this modification.

Terms in the event of cancellation: In the event of cancellation, the amount already paid by the customer will constitute the basis for the cancellation and may, at the discretion of SIMBELGIUM, be partially refunded or used as a deposit for a future order. Any deposit paid by the customer to the seller will not be refunded. If no deposit has been paid, the seller may claim from the customer termination compensation equivalent to 10% of the price of the products whose order was canceled by the customer. Personalized products are not refundable under any circumstances. In the event of cancellation, these products will be subject to full billing due to their unique nature.

No refunds can be made, each simulator being subject to customization. 

7. Delivery and installation
The products are delivered by specialized carriers (for example, Depaire, DHL, Bpost, etc.) to the address provided by the Customer and entered on the delivery note. The delivery times indicated are given for information purposes only. In the event of a delay, the Customer will be informed as soon as possible. A completion time between 4 and 16 weeks, depending on the type of simulator selected. However, this deadline remains indicative and may be modified in the event of possible delays from our suppliers. Delivery costs may vary depending on location and the customer can only intervene once delivery is underway. If the customer wishes to collect the product on their own, they must indicate this when preparing the quote. Once the quote is closed, the customer will not be able to recover the delivery costs. Delivery and installation are conditional on the conformity of the premises: clean space, operational power supply and internet connection. Any specific logistical needs (floor, elevator) must be indicated when ordering, with additional costs being the responsibility of the customer. SIMBELGIUM reserves the right to postpone the installation in the event of non-compliance. For installation, if included in the order, an appointment will be made with the Customer. SIMBELGIUM cannot be held responsible for delays due to external events (strikes, bad weather, etc.).

Upon receipt, the Customer must check the condition of the products and report any damage or non-compliance on the delivery note before signing. The customer must inform SIMBELGIUM within 48 hours of receipt.

Delivery for complete packs, if delivery is canceled for non-payment or payment not received before delivery, this amount will be borne by the customer. Subsequent deliveries will be rescheduled and at the customer's expense. Each delivery canceled/postponed at the customer's request will be the responsibility of the customer and will be their responsibility only for transport costs and possible cancellation costs.

The delivery note must be signed upon receipt of the simulators at the location indicated on the delivery note or modified beforehand. Responsibility for the simulators falls to the customer only after verification and signature of the delivery note attesting to their conformity. SIMBELGIUM remains responsible for damage linked to transport or non-conformity noted during delivery.

International Shipping: 

Prices excluding delivery: The prices of "full pack" simulators indicated on our site or in our commercial communications do not include delivery costs. These are billed additionally and determined based on the following parameters:

The delivery address • The weight and dimensions of the package • Insurance for the value of the machine.

8. Warranty and after-sales service (after-sales service)

All products benefit from a 2-year manufacturer's warranty (parts and labor), from the date of delivery. 
The customer wishing to invoke the legal guarantee must inform Simbelgium within 10 days of noticing the defects. It is nevertheless recommended to report these defects as soon as possible.
The customer undertakes to take all necessary measures to avoid any worsening of the damage, in particular by suspending the use of the simulator if necessary. Failing this, this deterioration may be taken into account to determine Simbelgium's intervention methods.

Service Technique

SIMBELGIUM technical service is available Monday to Friday, from 10:00 a.m. to 5:00 p.m., excluding public holidays.

Any request for technical intervention must be scheduled in advance by appointment by sending us an email.

SIMBELGIUM strives to respond to technical requests as quickly as possible, but cannot guarantee immediate intervention, except in previously validated emergency cases.

Technical interventions carried out outside the mentioned hours may be subject to additional pricing, after prior acceptance by the Customer.

Travel costs, spare parts or any service not included as part of the guarantee will be invoiced according to the estimate previously accepted by the Customer.

This warranty covers manufacturing defects, excluding:

• Damage due to misuse or negligence (burns, excess weight on the simulators, etc.)

• Unauthorized modifications or repairs carried out by third parties.

In the event of a return, to activate the warranty, the Customer must contact SIMBELGIUM and follow the instructions for returning the product.

In the event of a breakdown, the following procedure must be followed:

1 Disassembly: The product must be carefully disassembled by the customer before shipping. SIMBELGIUM declines all responsibility for damage caused during dismantling carried out by the customer.

2 Product return: The defective product must be shipped:

• Or directly from Simbelgium at the address provided.

• Or at the designated address of the authorized repair service.

3 Customer Obligations: Tracking number: The customer must provide SIMBELGIUM with the tracking number provided by the carrier, allowing tracking of the shipment.

Mandatory insurance: The customer is required to take out transport insurance covering the total value of the product. Proof of this insurance must be sent to SIMBELGIUM at the same time as the tracking number and a photo of the packaging before sending it.  

Responsibility :

In the absence of proof of transport insurance or tracking number, SIMBELGIUM cannot be held responsible for losses or damage occurring during transport.

Failure to follow this procedure may result in SIMBELGIUM refusing to take charge of the breakdown. Any dismantling without prior authorization or modification of the chassis voids the 2-year warranty on the simulator components. Any on-site intervention at the customer's premises, requested by the customer, will result in additional costs including:

Travel costs, calculated based on distance. Labor cost, billed according to the time required for the intervention.

Possible supplements, linked to the nature or complexity of the intervention. These costs will be communicated in advance to the customer for validation. The intervention will only be carried out after written acceptance of these conditions.

In certain cases, SIMBELGIUM may ask the Customer to acquire the missing part or component on their own. The reimbursement will be made on the basis of the purchase invoice sent to SIMBELGIUM, subject to compliance with the following conditions:

Prior to any purchase, the Customer must submit to SIMBELGIUM a price offer or a quote for validation.

Simbelgium must give written consent before acquiring the part or component.

Reimbursement will be made according to the following terms:

Transmission of the original invoice or a certified copy.

Verification by SIMBELGIUM of the conformity of the part or component to its technical requirements.

Reimbursement will take place within 30 days following validation by SIMBELGIUM.

In the event of non-compliance with this procedure, SIMBELGIUM reserves the right to refuse reimbursement.

Additional costs (installation, delivery, etc.) incurred by the Customer without prior authorization from SIMBELGIUM will not be reimbursed.

Exceptions and non-returnable items:

Personalized products, such as full pack racing simulators or any other tailor-made item, are neither returned nor refunded. If you have any questions or concerns regarding a specific item, please do not hesitate to contact us.

Disclaimer of Warranty

The warranty does not apply in the following cases: Improper use: Products used in a manner that does not comply with the instructions or intended uses (recommendations provided by SIMBELGIUM) are excluded from the warranty. Failure to maintain: Any defect resulting from a lack of regular or inappropriate maintenance, as indicated or stipulated orally by SIMBELGIUM will not be covered. Updates not carried out: Failure to install updates, patches or technical recommendations provided by SIMBELGIUM for the proper functioning of the product results in exclusion of the warranty.

These exclusions include, but are not limited to: mechanical, electronic or software damage caused by negligence or improper handling, as well as any unauthorized modification of the products. To guarantee complete coverage, the customer must strictly comply with the use, maintenance and update guidelines communicated by SIMBELGIUM.

9. Software and Content

Prohibited modifications: It is strictly prohibited to modify, delete or integrate games, software or programs other than those initially installed by SIMBELGIUM on the simulators or computers provided. Any unauthorized intervention, which may result in compatibility problems, malfunctions, bugs or adjustments, will automatically render the warranty void. Consequences of unauthorized interventions: In the event of violation of this rule, SIMBELGIUM may refuse any free technical assistance. If the Customer wishes intervention to repair malfunctions caused by unauthorized modifications, repair hours as well as travel costs will be invoiced to the Customer. Addition of specific content: The integration of new circuits or cars can be carried out, but only by SIMBELGIUM. This service is subject to a prior estimate and must be paid before the intervention.

Any attempt to add content by the Customer or an unauthorized third party is prohibited and will result in the same consequences as those mentioned for unauthorized interventions. SIMBELGIUM reserves the right to check at any time the integrity of the software installed on the delivered products to guarantee their conformity.

10. Logos 

The products delivered by SIMBELGIUM include logos, signs and markings identifying the brand and its partners. These elements are an integral part of the delivered products.

It is strictly prohibited to remove, mask, alter or modify the logos and signs appearing on the products for a period of 10 years from the date of delivery.

In the event of non-compliance with this obligation : SIMBELGIUM reserves the right to suspend or cancel access to the technical service.

Any subsequent technical intervention, if accepted, will be invoiced to the Customer, even if it would have initially been covered by a warranty or free assistance.

Simbelgium may also ask the Customer to bring the products into conformity by reinstalling missing logos or signs, at its expense.

11. Use of Software and Content

It is strictly prohibited to modify, delete or integrate games, software or programs other than those initially installed by SIMBELGIUM on the simulators or computers provided. Any unauthorized intervention, which may result in compatibility problems, malfunctions, bugs or adjustments, will automatically render the warranty void.

12. Retention of title

The products remain the property of SIMBELGIUM until their full payment. In the event of non-payment, SIMBELGIUM reserves the right to recover the delivered products, at the Customer's expense.

13. Consignment sale: In the event of resale of your machine, we offer the possibility of offering it for consignment sale in our showroom. Once the machine is sold, the agreed amount will be paid in full.

14. Data confidentiality

SIMBELGIUM is committed to protecting the personal data of its Customers in accordance with the GDPR. The data collected is used only within the framework of the commercial relationship.

15. Disputes

We nevertheless reserve the right to submit any possible dispute exclusively to the courts. In the event of a dispute, the courts of the seller's head office have jurisdiction, unless legally binding provisions to the contrary exist. 

Any order for products implies unreserved acceptance of these general conditions of sale, supplemented or amended by our special conditions, which cancel any contrary clause that may appear in the conditions of purchase, order forms, or other commercial documents.
